and conditions governing use of the Hotel Fusion
website
These terms and conditions set out the rights and
obligations of all users (either as individuals or
as a group) and those of Hotel Fusion in relation to
the services offered by Hotel Fusion by way of this
website. Before you click on the "confirm"
button at the end of the booking process, please
carefully read these terms and conditions. By
clicking on the "confirm" button you are
consenting to be bound by these terms and
conditions. If you do not agree to all of the terms
and conditions, do not click on the
"confirm" button. If you have any

Parties
These terms and conditions are made between Hotel Fusion
Limited (“Hotel Fusion”) and whosoever shall use
this website (“You”).
Use of Site
You may only use the website to make legitimate
enquiries or bookings and hereby undertakes not to
make any speculative, false or fraudulent booking or
any booking in anticipation of demand. You also
undertake to provide correct and accurate e-mail,
postal and/or other contact details to Hotel Fusion
and acknowledge that Hotel Fusion may use these
details to contact you in the event that this should
prove necessary.
Making a Booking
Any booking made or order placed by you shall be
deemed to be an offer by you to purchase the
relevant hotel accommodation subject to these
booking conditions. No contract between you and Hotel Fusion
shall come into existence until Hotel Fusion (a)
issues a booking reference number; (b) issues a
booking confirmation by email or fax; and (c)
receives payment in full.
Amendments and cancellations by you
Cancellations made more than 14 days prior to
contracted arrival at the hotel will incur a
cancellation charge of 50% of the first night's
rate. Cancellations made more than 72 hours prior to
contracted arrival will incur a cancellation charge
of 100% of the first night's rate. Cancellations
made within 72 hours prior to contracted arrival
will be subject to full cancellation charges. On
occasions, particularly during fair periods it may
be necessary to vary these terms in accordance with
terms laid down by our suppliers. Hotel Fusion
reserves the right to alter this charging structure
in such circumstances by notifying you in advance
and gaining your acceptance.
If you do not arrive at the accommodation on the
date on which you booked to arrive or you leave the
accommodation earlier than the date on which you
booked to leave, then you will only be entitled to
cancel or amend the booking from the time when Hotel Fusion
receives notification from you during Hotel Fusion
working hours. All such cancellations and amendments
are subject to you incurring the charge for the next
twenty-four hours accommodation after Hotel Fusion’s
receipt of notification.
Cancellations and/or amendments of bookings will
only be valid if effected through the web site or to
Hotel Fusion in writing and reconfirmed to a
customer in writing by Hotel Fusion.
Amendments, cancellations and curtailment by
the hotel
In the very unlikely event that the hotelier cannot
provide the booked accommodation, you understand
that the hotelier's responsibility is to find an
alternative of at least a similar standard, and
provide transportation as appropriate to this
alternative hotel. Hotel Fusion takes every
precaution to ensure hotels are professionally
managed so that any such occurrence is extremely
rare. Hotel Fusion shall have no liability in
respect of any other costs, losses or damages
existing out of or in connection with relocation of
accommodation since such relocation is outside Hotel Fusion's
control.
Payment for reservations is due, in all cases,
before the customer travels. Regardless of whether
vouchers have been issued or not, Hotel Fusion
reserves the right to cancel reservations if payment
has not been received, or if payment is still
outstanding for any other unrelated reservations.
Accuracy of Information
Hotel Fusion and its suppliers have taken reasonable
care to ensure that the content of the website
including all hotel information, city information
and listings are accurate. The hotel information and
listings are compiled from information provided by
the hotels that are listed. Hotel Fusion publishes
such information in good faith. You acknowledge and
accept that Hotel Fusion cannot be held responsible
for any inaccuracies in such information, nor can
liability be accepted for changes to facilities
which are not notified to Hotel Fusion by the hotel
in question. You also acknowledge that while Hotel Fusion
endeavours to keep accurate and up-to-date all
information contained on this website, Hotel Fusion
cannot be responsible for errors, omissions or
misleading information contained in the hotel
listings or information.
Star Ratings and quality of Accommodation
You acknowledge that star ratings may vary in
quality from country to country and cannot be relied
on to identify the quality of the accommodation. You
acknowledge that the star rating is merely a general
outline and may not apply in each case. Similarly,
you acknowledge that the type of rooms provided by a
hotel (i.e. single, double, twin, triple) may also
vary from country to country. It is your
responsibility to check the type of the
accommodation and services provided by each hotel.
Details of each hotel which may be booked via this
website are outlined in this website.
Discounted rates
Hotels sometimes impose supplements which means that
the price advertised on Hotel Fusion may be higher
than the hotel's published rate. This can happen at
any period when rooms are very scarce. Hotel Fusion
will only sell a room at higher than the published
rate if it feels that its customer's interest is
better served by having this room rather than
finding nothing available at all. In such busy
periods, and only at the customer's request, Hotel Fusion
sometimes finds rooms in hotels which have been
reliably recommended by third parties. Such hotels
are offered to clients in good faith.
Complaints
Any complaint regarding the Hotel should be notified
to the Hotel Reception desk or to the relevant Hotel
Representative during your stay at the hotel and the
hotel management must be given adequate opportunity
to rectify the situation from the outset. Where any
such complaint is not rectified by the hotel in
question to your satisfaction, you should contact Hotel Fusion
immediately and Hotel Fusion will endeavour to
assist. Should you remain unsatisfied a further
complaint should be made in writing to Hotel Fusion
not later than seven days after termination of the
hotel stay. Where possible, the written complaint to
Hotel Fusion should be supported by photographs or
other written/visible proof of the complaint.
Passports and Visas
Hotel Fusion cannot be held liable for any loss
incurred in the event of your failure to hold the
necessary passports, visas and documentation for
their journey. You are advised to check with the
relevant visa departments of the Countries they wish
to visit.
Price changes
Hotel Fusion reserves the right to revise all
published prices at any time and for any reason,
however no change in price will be made once a
booking has been confirmed.
Room types
i) Twin/Double rooms: Hotels often have much fewer
double rooms than twins and the provision of a
double room by the hotel (even if requested as a
preference) is not guaranteed, unless its importance
is specifically mentioned to Hotel Fusion at the
time of reservation and Hotel Fusion then confirms
with the mention 'double' room
ii) Triple and Quadruple rooms: Some triple rooms
consist of three single beds while others consist of
one double and one single. In the same way quadruple
rooms can consist of four singles, or two double
beds, or one double and two singles.
Hotel Fusion cannot accept responsibility for any
specific needs not made known at the time of
booking.
Accommodation costs
On receipt of your voucher Hotel Fusion accepts
responsibility for paying your accommodation costs
and therefore cannot accept any responsibility for
clients who pay directly to the hotel.
Indemnity
You agree to indemnify and hold harmless Hotel Fusion
from and against any liability, damage or loss
including legal fees and expenses that Hotel Fusion
incurs or suffers as a result of any action,
inaction or omission by you.
Consequential Loss
Under no conditions and in no event shall Hotel Fusion
or its suppliers be liable for any consequential or
special damages or losses, however arising,
(including, but not limited to negligence or breach
of these terms and conditions or otherwise) or for
any loss of data, profit, revenue or business,
howsoever caused even if that loss or damage was
foreseeable by, or the possibility of it was brought
to the attention of Hotel Fusion.
Limitation of Liability
Notwithstanding the foregoing, Hotel Fusion's
liability to you and/or any third parties are in any
and all circumstances limited to the lesser of
either:-
(a) the amount paid by you of the booking; or
(b) £500.
Assignment
You may not assign, convey, sub-contract or delegate
any rights, duties or obligations hereunder except
with the written consent of Hotel Fusion.
Intellectual Property
You acknowledges that all copyright, trademarks and
other intellectual property rights in and relating
to this website are solely owned by or licensed to Hotel Fusion.
The content or data found on the website may not be
reproduced, sold, transferred or modified without
the prior written consent of Hotel Fusion. Neither
may you modify, duplicate, display, copy, reproduce,
licence, publish, transfer or sell any information,
software, products or services obtained from the
website without the prior written consent of Hotel Fusion.
You further acknowledge that you must not use any of
these intellectual property rights, except to the
extent necessary to make a booking in the manner
anticipated by these terms and conditions.
System Integrity
The usage of any device, routine or software which
inhibits or interferes with the running of the Hotel Fusion
website or any booking concluded upon it is
prohibited. Any action which creates a load on the Hotel Fusion
website or infrastructure which may be considered
unreasonable or disproportionate is prohibited.
No Guarantee of Continuous Access to Hotel Fusion
Website
Hotel Fusion does guarantee continuous access
without interruption to its website, nor does Hotel Fusion
guarantee secure access to its services. The
performance of the Hotel Fusion website may be
interfered with by many factors outside its control.
Amendment to These Terms and Conditions
Hotel Fusion reserves the right to amend these Terms
and Conditions at any time. Updates will be
effective 5 days after they are posted on the Hotel Fusion
website. This Agreement cannot otherwise be altered
without prior consultation with Hotel Fusion.
Severability
These terms shall be deemed severable. In the event
that any provision is determined to be unenforceable
or invalid, such provision shall nonetheless be
enforced to the fullest extent permitted by
applicable law and such determination shall not
effect the validity and enforceability of any other
remaining provisions.
Headings
The headings used in these Terms and Conditions are
included for convenience only and shall not define,
extend, limit or otherwise affect these Terms and
Conditions.
Force Majeure
If as a consequence of Force Majeure, Hotel Fusion
is obliged to curtail, alter or cancel a booking,
you shall not be entitled to claim compensation for
any loss arising as a consequence of the said
curtailment, alteration or cancellation. The term
"Force Majeure" includes but is not
limited to acts of God, natural disaster, fire and
any other destruction of any accommodation booked,
riots, acts of war or civil commotion, exercise of
legislative, municipal, military or other authority,
strikes, industrial action or any other reason
beyond the control of Hotel Fusion.
Entire Agreement
These terms contain the entire agreement between Hotel Fusion
and you and supersedes any prior understandings or
agreements (whether oral or written) regarding the
subject matter and may not be amended or modified
unless expressly agreed by Hotel Fusion in writing.
Governing Law
These Terms and Conditions are subject to English
Law and to the exclusive jurisdiction of the Courts
of England.
